DMCA (Digital Millennium Copyright Act) Policy

We take the intellectual property rights of others seriously and require that our customers and users do the same. The Digital Millennium Copyright Act (DMCA) established a process for addressing claims of copyright infringement. If you own a copyright or have authority to act on behalf of a copyright owner and want to report a claim that a third party is infringing that material on or through the Edge Impulse platform, website, or our other services, please send a written notice that meets the requirements of the DMCA (as set forth below), to copyrightagent@qualcomm.com.

DMCA notice requirements

  1. A description of the copyrighted work that you claim is being infringed;
  2. A description of the material you claim is infringing and that you want removed or access to which you want disabled and the URL or other location of that material;
  3. Your name, title (if acting as an agent), address, telephone number, and email address;
  4. The following statement: “I have a good faith belief that the use of the copyrighted material I am complaining of is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)”;
  5. The following statement: “The information in this notice is accurate and, under penalty of perjury, I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right that is allegedly infringed”; and
  6. An electronic or physical signature of the owner of the copyright or a person authorized to act on the owner's behalf.

You acknowledge and agree that if you fail to substantially comply with all of the requirements above, your DMCA takedown notice may not be valid. If we receive a valid DMCA takedown notice, we may send a copy, including any contact information you provide, to the user responsible for the challenged content.

We will review your submission and take whatever action we deem appropriate under the DMCA, including removal of or disabling of access to the challenged content if appropriate.  In appropriate circumstances, under our repeat infringer policy, we will also suspend or terminate the Edge Impulse accounts of users who repeatedly or egregiously infringe the copyrights of third parties.

DMCA Counter Notice requirements

You are free to try to resolve the DMCA notice with the party sending the DMCA notice in any lawful manner.  If content you made available on the Edge Impulse platform, website, or our other services was removed or disabled as a result of a DMCA notice, and you believe that such content is not infringing or that you have the proper authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law use the content, you may send a counter-notice to our DMCA Agent.   The DMCA Counter-Notice is a legal document and must comply with the requirements of the DMCA and must include the following in a written notice to our DMCA Agent at  copyrightagent@qualcomm.com:

  1. Contact Information: User's name, physical address, email address, and phone number
  2. Content Identification: A reasonable identification the material that has been removed or to which a user’s access has been blocked and the location at which the material appeared before it was removed or access to it was blocked.
  3. Statement under Perjury: A statement under penalty of perjury that you have "a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."
  4. Consent to Jurisdiction: A statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your provided address is located, or if your address is outside of the United States, for any judicial district in which Edge Impulse may be found.
  5. Consent to service of process: A statement that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  6. Signature: An electronic or physical signature of the Edge Impulse user who made the challenged content available.

You acknowledge and agree that DMCA Counter-Notices that don't meet all the requirements may be rejected.

If we receive a valid DMCA Counter-Notice, we will email a copy of the notice to the party that submitted the original DMCA takedown notice (i.e., the copyright owner or its agent), including any contact information you provide.  If the party sending the original DMCA takedown notice does not send our DMCA Agent evidence, within 10 business days following receipt of the DMCA Counter-Notice, that the copyright owner has filed an action seeking a court order to stop the user from making the challenged content available on the Edge Impulse platform, we may replace the challenged content or stop disabling access to it.

Trademark Takedown Request Policy

If you are a trademark owner, or an agent of a trademark owner, and believe that any content on the Edge Impulse platform, website, or other services infringes your registered trademark, please provide the following information:

  1. Details of the original trademark (and a description if it's a logo).
  2. A list of the countries in which the trademark is registered.
  3. The registration number(s) of the trademark.
  4. A scanned copy of the trademark registration certificate(s) or screenshot of the registration on the website or database of the applicable national intellectual property office(s).
  5. A declaration of the following statement: "By submitting this notice, I state that I have a good-faith belief that the reported use, in the manner that I have complained of, is not authorized by the intellectual property rights owner, its agent or the law; that the information contained in this notice is accurate; and, under penalty of perjury, that I am authorized to act on behalf of the owner of the intellectual property rights at issue".
